2. Scope
2.1 These Terms and Conditions apply to all contracts for online private lessons, group lessons, trial lessons, lesson packages, subscriptions and other digital educational services between Digi-Homeschooling and its customers.
2.2 A customer within the meaning of these Terms and Conditions is the person who books a course, lesson or other service with Digi-Homeschooling. In the case of minor students, the contract is concluded by the parents or other legal representatives.
2.3 Deviating terms of the customer shall not apply unless their validity has been expressly agreed in writing.
3. Subject Matter of the Contract
3.1 Digi-Homeschooling offers online private lessons, group lessons and other digital learning and support services.
3.2 The scope, format, duration, lesson times, prices and other details are determined by the respective booking, selected package, subscription or individual agreement.
3.3 Digi-Homeschooling is entitled to appoint suitable teachers for the provision of lessons and, if necessary, to replace them for organisational, professional or pedagogical reasons.
3.4 Lessons are provided exclusively online via the technical systems and platforms used or designated by Digi-Homeschooling.
3.5 Digi-Homeschooling owes the careful provision of the agreed services, but does not guarantee any specific academic or other concrete result, in particular no specific grade improvement, exam success, admission, promotion or issuance of a certificate.
4. Conclusion of Contract
4.1 The presentation of services on the website does not constitute a legally binding offer, but an invitation to make a booking.
4.2 The contract is concluded when the customer makes a binding booking or order via the website, the booking system, by email or by any other method provided by Digi-Homeschooling, and Digi-Homeschooling confirms the booking or activates the service or schedules the lesson.
4.3 The specific contractual content is determined by the service details shown during the booking process or individually confirmed.
5. Technical Requirements
5.1 The customer is responsible for ensuring that the technical requirements for participating in online lessons are met on their side. These include in particular:
a) a stable internet connection,
b) a suitable internet-enabled device,
c) a functioning microphone,
d) a functioning camera where required for the lesson,
e) a quiet and suitable learning environment.
5.2 Participation via tablet, laptop or desktop computer is recommended. Use of a mobile phone may reduce lesson quality.
5.3 Technical problems or other disruptions on the customer’s side are generally the customer’s responsibility.
6. Duties of Cooperation and Lesson Rules
6.1 The customer and the participating student are obliged to contribute to an orderly and respectful lesson environment.
6.2 The student must attend lessons punctually and prepared, and must behave during the lesson in such a way that proper teaching can take place.
6.3 Respectful behaviour towards teachers, other participants and Digi-Homeschooling staff is mandatory.
6.4 Offensive, discriminatory, threatening, harassing, sexually suggestive or otherwise inappropriate content, statements or behaviour are prohibited.
6.5 Access data, lesson links, logins and other personalised access credentials must not be passed on to third parties.
6.6 Lessons may not be recorded, stored, distributed or published on other platforms without the prior express consent of Digi-Homeschooling and the persons involved.
6.7 Teachers may provide lesson summaries, notes, homework and feedback via the system used.
6.8 Administrative matters, in particular payments, scheduling, group changes, certificates and comparable organisational issues, must be handled exclusively through Digi-Homeschooling’s official communication channels.
7. Prices and Payment Terms
7.1 The prices displayed at the time of booking or individually agreed shall apply.
7.2 Unless otherwise agreed, payment is due in advance.
7.3 Payment may be made by bank transfer, SEPA direct debit, card payment or any other payment methods offered by Digi-Homeschooling.
7.4 Lessons that have already been booked and already taken are generally non-refundable unless mandatory statutory provisions provide otherwise.
7.5 Subsequent price changes shall not apply retroactively to services already bindingly booked and paid for.
8. Cancellations, Rescheduling, Non-Attendance and Lesson Failure
8.1 Cancellation or rescheduling by the customer is generally possible up to 24 hours before the scheduled lesson.
8.2 In the event of cancellation less than 24 hours before the agreed lesson time, non-attendance, or if the student is not ready or not reachable at the agreed time, the booked lesson may be treated as completed and charged accordingly. In this case, there is generally no entitlement to a refund or make-up lesson.
8.3 If the lesson cannot take place properly due to technical problems on the customer’s side, the lesson may also be deemed completed.
8.4 If Digi-Homeschooling has to cancel a lesson for organisational reasons, due to illness of the teacher or due to technical issues, a replacement lesson will be offered where possible.
8.5 If a replacement lesson is not possible, the affected lesson will be credited, refunded or compensated by an equivalent substitute at Digi-Homeschooling’s discretion, unless otherwise individually agreed.
8.6 In cases of force majeure, in particular general internet outages, natural events, official measures or comparable circumstances beyond the control of either party, there shall be no claim for damages for the duration of the disruption. The parties shall seek an appropriate substitute solution.
9. Term and Termination
9.1 The term of the contract depends on the booked service.
9.2 One-time booked private lessons or lesson packages end automatically once the booked services have been fully provided, without the need for termination.
9.3 For ongoing offers or subscriptions, the terms and notice periods indicated during the booking process shall apply.
9.4 Unless otherwise agreed for an ongoing service, an open-ended ongoing service may be terminated in text form with one month’s notice to the end of the respective billing period.
9.5 The right to extraordinary termination for good cause remains unaffected.
9.6 Good cause may exist in particular in the event of:
a) repeated payment default,
b) serious or repeated breaches of these Terms and Conditions or the lesson rules,
c) unauthorised disclosure of access credentials,
d) unauthorised recording or publication of lessons,
e) serious disruption of lesson operations.
10. Right of Withdrawal
10.1 Consumers generally have a statutory right of withdrawal in distance contracts.
10.2 The details of the right of withdrawal, in particular the deadlines, conditions and consequences of withdrawal, are set out in the separate Withdrawal Policy provided on the Digi-Homeschooling website.
10.3 The statutory right of withdrawal remains unaffected by these Terms and Conditions.
11. Trial Lessons
11.1 Digi-Homeschooling may, at its own discretion, offer free or discounted trial lessons.
11.2 The scope, duration and conditions of a trial lesson are determined by the respective offer description.
11.3 There is no entitlement to a free trial lesson.
12. Copyright and Rights of Use
12.1 All content and materials provided by Digi-Homeschooling or the appointed teachers, in particular texts, exercises, presentations, worksheets, videos, concepts and other lesson materials, are protected by copyright.
12.2 These materials may only be used for the personal learning purposes of the booked student.
12.3 Any reproduction, distribution, publication, making available to third parties, paid or unpaid transfer to others, or any other use beyond the contractual purpose is prohibited without Digi-Homeschooling’s prior express written consent.
13. Liability
13.1 Digi-Homeschooling shall be liable without limitation in cases of intent and gross negligence, as well as for culpable injury to life, body or health.
13.2 In cases of slight negligence, Digi-Homeschooling shall only be liable for the breach of essential contractual obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.
13.3 The above limitations of liability also apply in favour of Digi-Homeschooling’s legal representatives, employees and vicarious agents.
13.4 Mandatory statutory liability provisions remain unaffected.
14. Data Protection
14.1 Personal data is processed in accordance with the separate Privacy Policy.
14.2 Insofar as necessary for the performance of the contract, personal data is processed in particular for communication, lesson organisation, service provision, invoicing and technical delivery.
15. Final Provisions
15.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions provide otherwise.
15.2 Should any provision of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
15.3 Individual agreements expressly made with customers shall take precedence over these Terms and Conditions.
